OCCRP вимагає скасувати рішення Незалежної медійної ради щодо присвяченої офшорам Порошенка програми «Слідства.інфо»

Центр дослідження корупції та організованої злочинності (OCCRP) направив листа до міжнародного фонду «Відродження» та Незалежної медійної ради, в якому вимагає скасувати рішення останньої щодо присвяченого офшорам Петра Порошенка випуску програми «Слідство.інфо»

Про це на своїй Facebook-сторінці повідомила шеф-редактор порталу «Детектор медіа» Наталія Лигачова.

У листі OCCRP його редактор Дрю Салліван називає невдоволення історією з офшорами політичним та пише, що, на його думку, критика на адресу «Слідства.інфо» може бути «політичною критикою, замаскованою під етичну».

«Якщо ви вважаєте, що “Слідство.інфо” погано виконало свою роботу, ви повинні погодитися з тим, що журналісти мають право час від часу погано її виконувати. Якщо Незалежна медійна рада прискіпуватиметься до кожного журналіста, чия історія їй не сподобається, вона перетвориться на перешкоду громадянському суспільству.

Я пропоную інше рішення. Я пропоную “Слідству.інфо” влаштувати дебати. Незалежна медійна рада скасовує рішення, яке ще тільки має ухвалити. Заяву видаляє з сайту. Всі ви збираєтеся в телеефірі та обговорюєте цю проблему. Це допоможе суспільству більше, ніж коли організації, які мають хороші наміри, сваряться між собою», - пише в листі Дрю Салліван.

«Детектор медіа» публікує повний текст листа англійською:

«The recent response by media organizations in Ukraine to a Slidstvo.info documentary related to the Panama Papers leak has been disappointing and even alarming. The response from the International Renaissance Foundation, an Open Society Foundation partner, the Media Council and various experts has been to chastise the non-profit for their work.

Slidstvo is an OCCRP partner organization and they, like us, are used to criticism of our investigative work often because we anger powerful people. But this criticism is unusual. We don’t object to criticism. We do object to the manner in which criticisms have been made and the issues they have with Slidstvo’s reporting.

The documentary told the story of President Petro Poroshenko’s registration of offshore companies to move his candy businesses to BVI. The companies were registered during the most destructive part of the war, during what is known as the Ilovaysk Kettle when Ukrainian troops were surrounded by Russian troops and killed in the hundreds. Slidstvo made an editorial decision to tell the story in that context.

Yesterday they were brought in front of the Media Council to defend themselves against ethical violations of professional journalism standards. Today, the International Renaissance Foundation total published a statement saying:

They resorted to the position of uncritical self-justification without any hint of recognition of their violation of journalistic standards, namely the manipulation of the facts. The authors of the investigation do not recognize that the connection between the President’s offshore company and the Ilovaysk tragedy is artificial; they have no evidence of the “Roshen” assets being moved to the offshore area, nor the evidence that offshore company was created precisely to avoid sales taxes.

It should be noted that NataliyaLygachova-Chernolytska is both the chairman of the Media Council and with the International Renaissance Foundation and was the most critical member at the Media Council hearing.

OCCRP objects to the Media Council proceedings and the statement for a few reasons.

There has been no question about the facts in this story. No one, not even Poroshenko and his representatives, have said any fact Slidstvo presented was wrong. There has been no issue about getting statements from Poroshenko and allowing for a robust response. The issue seems to have been the issue of presenting the story in the context of what was happening during the war. There is no question of this as a truth. Poroshenko did register his offshore during the worst days of the war. Yet the detractor’s fundamental point was that this is not fair.

This decision by Slidstvo was a journalistic decision. It was about presentation, context and narrative.  At no point did Slidstvo say there was a causal relationship and Poroshenko registered his company because the war was going bad.  At no point did they manipulate factual information to make it no longer factual. Nor did they say the assets were being moved to avoid taxes.  Both the Media Council and the statement actual mispresent Slidstvo’s story.

Obviously, however, any reader will see the two as related. And the degree of relationship may appear overstated.  However, these are journalism presentation decision and not ethical issues. To not present the context would also be wrong.

In the end, we are left with a story that is not ethical wrong. But reasonable people could argue with the decisions of the journalists and say they story may have been better served presented differently. In the end, we are just arguing about the quality of the story and not the ethics of the journalists.

Journalists should not be judged on these issues by Media Councils. The Media Council has no right to address these issues. Given the fact that so many media in Ukraine is bought and sold by oligarchs and political parties, this is the smallest of issues.

However, the story was politically disliked and it may appear that the criticism is political criticism masquerading as ethical criticism and that is far more dangerous and damaging to civil society.

If you think Slidstvo did a bad job, then you should agree that journalists have the right to do a bad job once in a while. If the Media Council drags every journalist who does a story they don’t like before them, they will become an impediment to civil society.

I suggest a different solution. I suggest Slidstvo host a debate. The Media Council should cancel its decision it has yet to make. The statement should be removed from the website. You should all convene on TV and debate this issue. That will help the public more than having organizations who’s intentions are good to fight among each other.

Нагадаємо, 3 квітня на трьох каналах - «Громадському ТБ», «UA:Першому» та каналі «24» - було показано розслідування програми «Слідство.Інфо» (проект «Громадського ТБ») «Подвійне життя президента» із циклу «Офшори державного рівня» щодо офшорних компаній Президента України Петра Порошенка, яке викликало професійну дискусію.

5 квітня Редакційна рада «Громадського телебачення» розглянула це дослідження на предмет дотримання редакційних стандартів. На думку редакційної ради, сюжетна лінія подій в Іловайську (на якій акцентується в розслідуванні про офшорні компанії Петра Порошенка) важлива для повного розуміння контексту подій, наведених у розслідуванні. Але стилістика подачі розслідування та надмірне використання архівних кадрів подій на сході України відволікає глядача від суті розслідування про офшори президента, зміщує сприйняття у площину емоцій.

Згодом виконавча директорка «Громадського телебачення» Катерина Горчинська назвала розслідування «Слідства.інфо» щодо президентських офшорів чесною помилкою.

11 квітня міжнародний фонд «Відродження» висловив розчарування з приводу реакції журналістів «Слідства.Інфо» на аргументовану критику їхнього розслідування щодо офшорних компаній Президента України Петра Порошенка. На думку фонду «Відродження», журналістська хвороба «права на абсолютну істину» підриває суть свободи слова, заміщуючи її простором компромату і маніпуляцій. «Немовби чесна позиція верховного судді, зайнята розслідувачами прихованої корупції, здатна перетворитися на свою протилежність, провокуючи розвиток масової недовіри до інформаційної місії ЗМІ», - застерігають представники фонду.
